Delaware District Court Announces Change in E-Filing and Service Deadline

Written By: Andrew J. Koopman

The Delaware District Court has announced a change to deadline times for the electronic filing and service of documents for cases within the District.  Effective October 16, 2014, electronic filings and service must be completed by 6:00 pm on the deadline day in order to be considered timely.  This change applies to all electronic transmissions of documents except initial pleadings, and includes motions, briefs, appendices, and notably, electronic transmission of discovery responses.  It will be important for lead counsel based outside of Delaware to be aware of this rule change so that they can prepare for the earlier filing deadlines on critical motions and responses.
